As\u00ed est\u00e1 reflejado en La Ley del Estatuto de los Trabajadores, publicada en 2015.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Esta gesti\u00f3n obliga al nuevo empresario a la <strong>subrogaci\u00f3n en los derechos laborales y de Seguridad Social<\/strong> del anterior propietario. Y tambi\u00e9n a la continuidad de las relaciones laborales que exist\u00edan antes de la venta de la empresa. Por lo tanto, el trabajador tiene asegurado su puesto de trabajo. Si fuera cesado, tendr\u00eda derecho a denunciar al empresario por un <strong>despido improcedente<\/strong>.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><b>\u00bfEn qu\u00e9 supuestos se da la subrogaci\u00f3n empresarial?<\/b><\/h2>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Como hemos comentado anteriormente, la subrogaci\u00f3n empresarial opera cuando se produce entre dos empresas una <strong>transmisi\u00f3n de activos<\/strong>, con soporte suficiente para que la empresa siga su actividad.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Cuando una compa\u00f1\u00eda <strong>pierde una contrata<\/strong>, cuya actividad principal es la mano de obra.
