{"id":5824,"date":"2019-09-12T11:45:20","date_gmt":"2019-09-12T09:45:20","guid":{"rendered":"http:\/\/martinezsanzabogados.com\/?p=5824"},"modified":"2023-09-08T14:38:28","modified_gmt":"2023-09-08T12:38:28","slug":"hipotecas-irph-reclamar","status":"publish","type":"post","link":"https:\/\/martinezsanzabogados.com\/en\/hipotecas-irph-reclamar\/","title":{"rendered":"Hipotecas con IRPH: c\u00f3mo reclamar hasta 21.000 \u20ac"},"content":{"rendered":"<h1>Hipotecas con IRPH: c\u00f3mo reclamar hasta 21.000 \u20ac<\/h1>\n<p>Esta semana hemos conocido el documento de conclusiones del Abogado General del Tribunal de Justicia de la Uni\u00f3n Europea que abre la puerta a que miles de hipotecas referenciadas al llamado IRPH (el \u00cdndice de Referencia de Pr\u00e9stamos Hipotecarios, una alternativa al Eur\u00edbor) puedan ser anuladas.<\/p>\n<p>El Abogado General de la UE considera que una cl\u00e1usula pactada entre un consumidor y un banco, que fija un tipo de inter\u00e9s tomando como valor de referencia el IRPH (uno de los seis \u00edndices oficiales legales), no est\u00e1 excluida del \u00e1mbito de aplicaci\u00f3n de la Directiva Europa y, por ello, puede ser objeto de un control judicial para ver si es abusiva o si se comercializ\u00f3 de forma transparente.<\/p>\n<p>Sus conclusiones vienen a corregir el criterio del Tribunal Supremo, que previamente hab\u00eda rechazado que pudiera controlarse la transparencia de dicho \u00edndice oficial, confirmando as\u00ed sentencias desestimatorias previas como las emitidas por la Audiencia Provincial de Valencia.<\/p>\n<p>Aunque estas conclusiones no son vinculantes para los estados miembros de la UE y habr\u00e1 que esperar al fallo definitivo del Tribunal de Justicia de la UE, sin duda se trata de un primer paso que puede acabar obligando a los bancos a recalcular los pr\u00e9stamos hipotecarios afectados y, por tanto, abrir la v\u00eda judicial para miles de afectados en Espa\u00f1a.<\/p>\n<p><strong>En Mart\u00ednez Sanz Abogados estaremos muy atentos a la situaci\u00f3n para ayudar a nuestros clientes a reclamar cantidades que pueden elevarse, incluso, hasta los 21.000 \u20ac, seg\u00fan los casos.<\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>Hipotecas con IRPH: c\u00f3mo reclamar hasta 21.000 \u20ac Esta semana hemos conocido el documento de conclusiones del Abogado General del Tribunal de Justicia de la Uni\u00f3n Europea que abre la puerta a que miles de hipotecas referenciadas al llamado IRPH (el \u00cdndice de Referencia de Pr\u00e9stamos Hipotecarios, una alternativa al Eur\u00edbor) puedan ser anuladas.
